1. Agreement to Terms
By accessing and using the UpNorth Creative website (upnorthcreative.co), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our website.
2. Services
UpNorth Creative provides brand strategy, creative, content, digital, and marketing automation services on a project basis. Specific scope, deliverables, timelines, and pricing are agreed upon in a written proposal or project agreement before any work begins.
3. Payments
Payment terms are outlined in individual project agreements. A deposit is typically required before project commencement. UpNorth Creative reserves the right to pause or terminate work if payments are not received in accordance with the agreed terms.
4. Intellectual Property
Upon full payment, clients receive ownership of the final deliverables specified in their project agreement. UpNorth Creative retains the right to display completed work in its portfolio unless otherwise agreed in writing.
All website content, branding, and design of upnorthcreative.co remain the intellectual property of UpNorth Creative.
5. Client Responsibilities
Clients are responsible for providing accurate information, timely feedback, and any required assets or approvals. Project delays caused by client response times are not the responsibility of UpNorth Creative.
6. Limitation of Liability
UpNorth Creative is not liable for any indirect, incidental, or consequential damages arising from the use of our services or website. Our total liability shall not exceed the fees paid for the specific project in question.
7. Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information shared during the course of a project, unless disclosure is required by law.
8. Termination
Either party may terminate a project agreement with written notice. Any work completed up to the point of termination is billable. Deposits are non-refundable unless otherwise stated in the project agreement.
9. Governing Law
These terms are governed by the laws of Ontario, Canada. Any disputes shall be resolved in the courts of Ontario.
